Makoto Nishimoto, a member of the Miyazaki Municipal Assembly, has been indicted by the Miyazaki District Public Prosecutor's Office on charges of sexual assault leading to injury.

Nishimoto, 37, who was elected as a member of the municipal assembly in April under the name Super Crazy-kun — meaning “super crazy guy” — was charged on the grounds of nonconsensual sexual intercourse resulting in injury. The victim was a female acquaintance in her 30s.

The prosecutors office has not disclosed whether Nishimoto, a former YouTuber and singer, has admitted or denied the charge.

According to the indictment, Nishimoto allegedly grabbed the arm of a female acquaintance, dragged her to a hotel in the city of Miyazaki and sexually assaulted her on Sept. 3. It is also alleged that she suffered injuries to her hands and arms when she fell from the hotel staircase while trying to escape.

During a news conference at the Miyazaki City Hall after meeting with Nishimoto, his lawyer Hirotaro Kato reportedly revealed that he will ask the court to apply nonconsensual indecency to the case.

“No strong violence was used and no clothes were removed,” Kato said.

Kato also revealed that Nishimoto has generally admitted the charges and expressed deep remorse to the public, saying that he is “deeply sorry” and that he would like to explain himself “with his own words” later, Kyodo News reported.

Nishimoto was arrested by the Miyazaki Prefectural Police on Sept 6. on suspicion of nonconsensual sexual intercourse resulting in injury. The municipal assembly unanimously passed a resolution recommending his resignation at a plenary session on Sept 11.

In June, the nation’s sexual crime laws were revised, redefining rape as “nonconsensual sexual intercourse” so the perpetrator can be convicted without the use of force or intimidation. Nonconsensual sexual intercourse is a crime that carries more than five years of imprisonment, while nonconsensual sexual intercourse that results in injury is punishable by at least six years in prison and life imprisonment at the maximum.
